CONTRACT OF SALE

Upon sale of all of my puppies, New Owners must provide a valid US Identification and sign my Puppy Contract. This is to protect both parties. My contract includes my Health Guarantee, Spay/Neuter Agreement and a Responsible Owner Agreement. My Contract is legally binding and I will pursue a lawsuit if a New Owner (Buyer) breaches contract at any time. I will provide a printed copy of this contract at time of sale.

Responsible Ownership Agreement:

By signing below, I as the New Owner agree to be a responsible Dog Owner and take responsibility for the physical and emotional well being of this animal. I agree and commit to training this dog so that he/she can have the best quality of life and be a respectable member of my family. I agree to do research and provide a good quality diet for my dog. I understand that the Pomeranian is a double coated breed and requires frequent brushing to prevent matts. I understand that shaving a double coated breed can be detrimental to their health and will not help them stay cool during warmer months. I agree that if I cannot groom my Pomeranian myself that I will take them to a professional dog groomer. I understand that a Pomeranian can easily fall off of furniture/down the stairs/be dropped by children and result in serious injury or death. I agree to watch my new puppy and keep them safe. I agree that I have done research on Hypoglycemia and I will do my best to prevent it from happening to my new puppy. I Understand that if at any point in this dog's life I am unable to keep him/her that I will return him/her to the breeder and/or contact the breeder for help rehoming him/her. I will not at any point in their life take my puppy to the shelter.

Health Guarantee (as shown on Candyshoppoms.com):

I as the Breeder guarantee this puppy against any life threatening congenital disease. Parents of this puppy were carefully chosen to be paired and were OFA and Embark tested. In the event that this puppy has a life threatening congenital disease it will need to be diagnosed by a licensed Veterinarian at Buyers expense within 1 week (7 days) of leaving the Breeders home. Breeder reserves the right to have the puppy checked by a Veterinarian of her choosing before any final decisions are made. 

*Breeder has never produced a puppy with life threatening congenital defects/diseases, but has this policy to protect New Owners/Buyers in the event that it does happen.*

If it is decided that the puppy has a life threatening congenital disease/defect then Breeder will take the puppy back and issue a full refund, or place Buyer back on the puppy waiting list and let them pick another puppy of equal or lesser value from an upcoming litter. 

Breeder DOES NOT guarantee how the puppy will react to vaccines. Pomeranians are a fragile Toy Breed and they often have reactions to vaccines, Especially Leptospirosis and Rabies. Wait until your puppy is at least 4 months old before you vaccinate for Rabies and please DO NOT get your Pomeranian vaccinated against Leptospirosis (Commonly called Lepto). It is not a core/required vaccine and often causes more harm than good. 

Breeder DOES NOT guarantee against the following, once a puppy has been out of her home for more than 24 hours:

  • Parvovirus

  • Canine Infectious Tracheobronchitis (Kennel Cough)

  • Leptospirosis

  • Rabies

  • Canine distemper

  • Luxating Patella

  • BSD (Black Skin Disease)

  • Breeding Ability (if you purchased a puppy with full rights and no Neuter Contract)


By signing below, I as the New Owner acknowledge the Health Guarantee that comes with this puppy. I agree to carry on with vaccines. I agree that in the event that I believe my new puppy has a Life Threatening Congenital Defect, that I will contact the Breeder ASAP so that we can come to a resolution. I will not take to social media to bash, or speak badly about the Breeder.

Spay/Neuter Agreement:

Permanent ownership of this dog is contingent upon your compliance with this Agreement.

The Breeder must receive proof of the spay/neuter procedure having been performed no later than the puppy becoming 13 months of age. Proof must be received within fourteen (14) days after completion of the surgery. This notice can be in the form of a Certificate of Spay/Neuter or an Invoice from the Veterinarian showing the procedure has been completed. 

In the event the dog’s health does not allow this agreement to be honored, Breeder must be provided with a statement from your veterinarian that this dog is not yet in physical or emotional condition for surgery. Based upon the veterinarian’s evaluation of this dog the Buyer will contact the veterinarian and establish the earliest date that the procedure can be performed. The Buyer will notify the Breeder of this amendment in writing, at which time all other conditions of this contract will apply and be enforced.

It is the responsibility of the Buyer, not the veterinarian, to ensure that the Breeder has received verification that the surgery has been performed. Failure to comply with this contract by the date below, unless otherwise agreed to in writing, will be considered a breach of the Contract. The Purchaser will be liable for a fee of $5000.00. In addition, it will result in the Health Guarantee being null and void.

By signing below, I the New Owner agree to have this dog spayed/neutered by no later than __________, and I understand that this contract is an agreement that this dog will not produce a litter of puppies either as purposely bred or by accidental breeding. If a pregnancy occurs whether purposely or accidentally, the Buyer agrees to pay the additional cost for a breeding dog, which is a $5000.00 fee and return the puppy to the breeder.

I (New Owner) affirm by signing below that I have read and understand the above contract and understand that it is Legally Binding. Breeder can and will pursue me in the Court Of Law if this contract is breached. I understand that the Breeder will be keeping a copy of this agreement. I understand that I can reach out to the breeder at any point during the life of my dog for advice, questions, or help of any kind.
